Preventive Practices

The task of managing a business has become increasingly more difficult as new laws regulating the workplace are adopted at all governmental levels, and the courts expand the rights of employees. In order to avoid liability for violating the law, exposure to an excessive jury award, and the risk of significant legal fees in defending the business, it is essential for management to be educated to the issues and adopt a proactive approach in dealing with this high-risk area.

The primary focus of SWERDLOW FLORENCE SANCHEZ SWERDLOW & WIMMER's practice is assisting its clients in adopting and implementing an effective, preventive human resource program, and--in the process--avoiding litigation. The basics of such a program involve training and development of appropriate and ever-current policies and procedures, including employment applications, employment agreements, a comprehensive employee handbook, and personnel policies and procedures covering such varied subjects as at-will employment, discrimination and harassment, mediation and arbitration, rules of conduct, protection of proprietary information and technology usage. Our experience has demonstrated that the cost of developing such a program is the most cost-effective means to utilize the services of labor and employment counsel and will have very positive human resource benefits.
